Similarly, when you submit your project details and provide your contact information, HandyAmerican.com will attempt to locate and match you and your project requirements to a suitable contractors in your area, who will contact you directly. However, we do not guarantee that we will be able to match your request with suitable contractors, if any.
We make no guarantees nor endorsements regarding the skills or the quality of the job that the contractor(s) may perform for you if you hire them. HandyAmerican.com does not endorse or recommend the services of any particular contractor. It is entirely up to you to enter into a direct contract or otherwise reach agreement with a contractor, and we do not guarantee or warrant their performance on the job or the outcome or quality of the services performed. We strongly encourage all consumers to properly screen any contractor or other service professional prior to hiring. The contractors or other service professionals affiliated with HandyAmerican.com are not employees or agents of HandyAmerican.com, nor is HandyAmerican.com an agent of the contractors. HandyAmerican.com does not perform, and is not responsible for, any of the services requested by you in your project submission or via your Directory search.
When you enter into a contract with any contractor, your rights are governed by the terms of that contract and by applicable federal, state, provincial and local laws. Should you have a dispute with any contractor, you must address the dispute with the contractor, or the contractor’s representatives directly.
BY USING THE HANDYCANADIAN.COM SERVICE, YOU AGREE TO RELEASE HANDYCANADIAN.COM (AND OUR OFFICERS, DIRECTORS, AFFILIATES, EMPLOYEES AND AGENTS) AND ANY OTHER PERSON, FIRM, OR ENTITY FROM ANY LIABILITY, DAMAGES OR CLAIMS (INCLUDING CONSEQUENTIAL AND INCIDENTAL DAMAGES) OF EVERY KIND OR NATURE, SUSPECTED AND UNSUSPECTED, KNOWN AND UNKNOWN, AND DISCLOSED OR UNDISCLOSED, IN ANY WAY CONNECTED WITH YOUR DEALINGS WITH CONTRACTORS.
2. Feedback, Ratings, Reviews, Rebuttals and Testimonials Policy
Homeowners who employ the services of contractors listed in the HandyAmerican.com Directory are encouraged to submit testimonials and ratings of the contractors’ performance. Only those who have hired a contractor can submit a testimonial and a rating for that contractor.
HandyAmerican.com makes no claim to verifying the authenticity or accuracy of any testimonial before it is published to its website. HandyAmerican.com will not edit testimonials in any way other than to correct spelling mistakes and blatant grammatical errors. HandyAmerican.com has the discretion to remove testimonials that include foul or vulgar language. Notwithstanding, HandyAmerican.com reserves the right to add, change or remove reviews at any time. HandyAmerican.com is not responsible for the contents of reviews posted to any contractor's profile.
A copy of your testimonial(s) may be sent to the contractor you have reviewed. The contractor has the opportunity to post their rebuttal when receiving an unfavourable testimonial.
Homeowners should be careful to only post accurate statements about their experience with their contractors, as slander and libel laws are designed to protect people/companies from testimonial misuse.
A homeowner can post only one testimonial per contractor per job, although homeowners can edit their testimonial upon further reflection. All changes will be subject to the same review process as new testimonials.
3. Forums and Blogs
"Forum" means a chat area, bulletin board, e-mail or any other message or communication facilities or functions offered as part of this Site. “Blog” means a weblog, or a personal online journal in the public domain permitting commentary from other HandyAmerican.com members. If you participate in any Forum or Blog, you must not:
- commit any criminal or quasi-criminal offence, including without limitation, any crimes relating to pornography, threats, intimidation, hate, assault, or that is economic in nature;
- defame, abuse, harass, stalk, threaten or otherwise interfere with or harm the contractual, personality, confidentiality, privacy or publicity, moral, statutory, common law or intellectual property rights of any other person;
- publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information;
- upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of our computer systems or those of any user;
- delete or alter any author attributions, trade-marks, trade-names, logos, legal notices or proprietary designations or labels in any file that is uploaded or downloaded;
- falsify the origin or source of software, information or other material contained in a file that is uploaded or downloaded;
- advertise, solicit or offer to sell any goods or services, or conduct or forward any surveys, contests, or chain letters;
- download any file posted by another user of a Forum that you know, or reasonably should know, cannot be legally distributed in such manner; or
- engage in any conduct that encourages, conspires, entices or promotes the occurrence of any of the prohibited conduct stipulated herein.
You acknowledge and agree that all Forums and Blogs involve public and not private communications, and that they can only be used for non-commercial purposes. Further, you acknowledge and agree that chats, postings, conferences, and other communications by users are not monitored, screened, sanctioned or endorsed by us, and such communications shall not be considered reviewed, screened, or approved by us. However, we reserve the right, but not the obligation, to monitor the content of this Site, including the Forums and Blogs, and to remove, refuse to post or edit any material or content which we, in our sole discretion, determine to be in violation of the provisions hereof or otherwise objectionable. Visitors shall remain solely responsible for the content of their communications. We reserve the right, in our sole discretion, to deny any user access to this Site without notice.
By posting, uploading or submitting any material or content to any Forum or Blog or otherwise submitting any material or content to us, you automatically grant (or automatically warrant that the owner of the rights to such material or content has expressly granted) us a perpetual, royalty-free, irrevocable, non-exclusive right and license throughout the world to use, reproduce, modify, adapt, create derivative works from, publish, translate, license, transmit, distribute and otherwise exploit any or all portions of such material or content in any manner and media and by means of any technology now known or hereafter developed. 4. Privacy Policy
HandyAmerican.com is committed to protecting your privacy. Data collected is for the sole purpose of matching you with a contractor. Outside of our network of contractors, we will not sell, trade or rent your personal information to a third party without your permission. We may send you offers through email or otherwise which we deem relevant to your specific project. You, at any time, may request to no longer receive such offers, at which time you will be removed from the list of offers within a 30 day period.
In the course of using the services provided by HandyAmerican.com, you will be prompted to provide information about yourself and your project details. Some of this information will be sent to contractors who will need this information in order to respond to you (or to other persons or entities) in connection with your project. By providing this information to us, you are requesting, and you expressly consent to being contacted by us and by our affiliated contractors in order to provide the services set forth on our site, to service your account, to address matters pertaining to your account or to your project or project submission, or for other purposes related to our business.
HandyAmerican.com does not control the privacy policy of third parties who advertise, batch or transfer information to our service. A third party may have a privacy policy that is different from that of HandyAmerican.com. In these instances, data that you submit to our service via a third party may be shared by that party.
HandyAmerican.com may provide marketing statistics to reputable third parties without disclosing contact information or any personally identifying information. HandyAmerican.com collects information though the use of cookies to determine the effectiveness of our site and to enhance your experience with us.
